Attorney Kevin D. Bland will be speaking at the next meeting of the ASSE’s Orange County Chapter, on March 16. The topic of his presentation will be AB 2774 and Bland will also deliver an update on Cal/OSHA regulations.
The meeting will be at 11:30 am, at the Green Parrot Villa, located at 2035 N. Main St., in Santa Ana, across from the Bowers Museum.
AB 2774 has changed the definition of what’s considered a serious workplace violation — and raised the monetary penalty for serious citations to up to $25,000 per violation. Additionally, the bill changes how a serious violation is investigated and the appeals process for Cal/OSHA citations, according to the Insurance Journal.
Kevin D. Bland is a partner of Hines Smith Carder Dincel Bland and he focuses his practice on the construction industry. Mr. Bland holds a Contractor’s “A” License and has both practical and legal expertise in construction safety, construction risk management, construction litigation and construction contract claims as well as OSHA citation appeals and rulemaking. He counsels and represents general contractors, builders, trade contractors, crane and rigging contractors, trade associations, construction contractors, material suppliers and various other non-construction industries.
Mr. Bland brings nearly two decades of field construction experience to the table. He began his construction career as an Iron Worker in Los Angeles, California where he worked as an erection foreman on high-rise buildings. Mr. Bland has also served as Vice-President of a corporation that was accredited by United States and California Departments of Occupational Safety and Health Administration to perform testing of construction crane equipment and other material handling devices. As an expert consultant, he has advised general contractors, offshore oil platform operators, and crane and rigging contractors regarding construction planning, safety, and crane operation practices.
Mr. Bland has participated in and represented clients on various rule-making advisory committees for the Division of Occupational Safety and Health and has served as a consultant to the Crane Unit in the development of load testing procedures for mobile cranes. He was instrumental in the development of the “Snyder Langston Mobile Crane Safety Manual Policies and Procedures” that won the International Risk Management Best Practice Awards for loss control, risk financing, risk transfer, and risk analysis in 1999. In addition to his Civil Practice, Mr. Bland regularly practices before the Cal-OSHA Appeals Board, DOSH Standards Board, and the Nevada DIR Commission.
The previously scheduled speaker, Mr. Steve Donohoe, will be delivering his presentation at the OC ASSE meeting on Tuesday, June 21, 2011. The topic of that meeting will be Swimming Pool/Spa Safety and ADA.
